Several states across the nation have since enacted abortion bans with states choosing different exemptions for medical abortions. Louisiana’s trigger law went into effect in late June 2022 and reports of misinterpretation and confusion have been accounted for since then. In the fall of 2022, a pregnant woman went to two different hospitals in Baton Rouge that would not give her the answer of if she were having a miscarriage or not. The family told National Public Radio that a nurse said it was a miscarriage but that “they didn’t want to say that’s what it is” (Westwood, 2022). An earlier case in Louisiana took place when a pregnant woman was denied an abortion after the fetus was diagnosed with Acrania, which is on the list of exemptions for medically futile abortions (Woodruff, 2022). Kettl referenced the three themes of public administration as politics, performance, and accountability (Kettl, 2017, pg. 5). Abortion bans relate to public administration because the emphasis of women receiving the fear and burden of the laws. Male partners do not have any consequences from these interactions. The consequences will impact women’s lives even in cases of rape and incest in various states. Yes, only one of the partners would birth the child but why is all of it on women? This is simply one of the politics of this topic. The second theme of performance would relate to how effective the policy is being currently implemented. In the case of abortions, how is this performance being measured? If doctors are holding off on potential preventative care due to fear of losing their medical license, is that effective care or performance? “Legislators who are not doctors should not be practicing medicine, but if they’re going to, they ought to have an understanding of the science of fetal development and fetal health,” said Dr. Rebekah Gee, an OB-GYN, CEO of Nest Health, and former secretary of the Louisiana Department of Health (Woodruff, 2022). Legislators have a big responsibility to create the policies that their campaigns were built on but how can they know everything? How can someone that may not understand something outline a policy that the administration must deliver? White suggests that with the overwhelming list of problems that legislators must solve, they must rely on experts for the technical questions. Experts on diverse topics are invaluable to the legislators as they cannot know everything (Shafritz, 2017, pg. 71). It should not be asked of legislators to know everything, or that a number or lack of degrees means understanding of research but there should be accountability in the research. What qualifies someone to be a legislator’s expert? Where is the money from the research studies coming from? What are the thoughts from other experts in the specific field? These are just a few questions that should be considered before making decisions that will affect the lives of any number of individuals. Here are my main questions. If public administration is how the policies are put into action, what steps need to be taken to ensure that legislators are qualified to make these decisions? Should there be any adjustments to the Constitution on the current qualifications to run for office? Current requirements to run include specific ages, United State citizenship for a specified number of years, and residency in the place that you intend to represent? How do you make a list of requirements ensuring that the elected officials are not only trusted for their word but competent enough to understand the diverse topics they will encounter in office?
