4. Scenario
Service connection for a Veteran’s claim can be granted on a direct or secondary basis. One of the responsibilities of the Veterans Service Representative (VSR) is to obtain any necessary medical examinations and medical opinions for the conditions the Veteran claims. Another responsibility is to obtain all medical records (federal and private) that the Veteran identifies as part of their claim. 38 CFR 3.159 defines the Department of Veterans Affairs duty to assist in developing Veteran’s claims. Per this regulation, certain elements must be met before an examination and medical opinion are warranted and reasonable efforts must be made to assist Veterans in obtaining evidence. These requirements are described in detail in the M21-1 Adjudication Procedures Manual. For this exercise, manual references should be provided in the following format: M21-1 III.i.1.A.1.a.
